# Anyra Anonymizer — Terms of Use

## 1. Acceptance

By opening, downloading, or otherwise using the Anyra Anonymizer (the "Tool"), you agree to these Terms of Use. If you do not agree, do not use the Tool.

## 2. Nature of the Tool

The Tool is a **single HTML file** published by Anyra, Inc. ("Anyra"). It runs entirely within your web browser on your own device. Your data files are not transmitted to Anyra, to any server, or to any third party as part of the Tool's operation.

**Anyra is a software publisher.** Anyra does not receive, store, transmit, or process data that you load into the Tool; all processing occurs within your own browser on your own device. What agreements, approvals, or reviews are required before your district uses this Tool is a determination for your district and its counsel.

## 3. Your Responsibilities

You are solely responsible for:

1. **Authorization.** Ensuring you are legally authorized to access the source data before you use this Tool. The Tool does not grant or verify any access rights.

2. **Output review.** Reviewing the anonymized output file in full before sharing it with any third party, including AI tools, cloud services, email recipients, or shared storage. The Tool provides a best-effort anonymization based on auto-detected patterns; you must verify that the output meets your district's disclosure-avoidance standards.

3. **Handling of sensitive artifacts.** Securely storing and handling the original source file, the mapping file (`mapping.json`), and the anonymized output according to your district's data-handling policies. The Tool does not encrypt files and does not prevent you from mishandling them after they are created.

4. **Classification accuracy.** Reviewing and, where appropriate, correcting the Tool's auto-classification of columns. The Tool flags risky classifications but will proceed if you explicitly override warnings.

5. **Local retention decisions.** Deleting any raw source data and mapping files from your device when they are no longer needed.

## 4. No Warranty

THE TOOL IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION:

- Any warranty of merchantability or fitness for a particular purpose
- Any warranty that the Tool will meet your requirements
- Any warranty that the Tool will be uninterrupted, error-free, or secure
- Any warranty concerning the accuracy or completeness of output
- Any warranty concerning the suitability of output for sharing with any third party

Anyra makes no representation that use of the Tool will result in, or is sufficient for, compliance with the Family Educational Rights and Privacy Act (FERPA), the California Student Data Privacy Agreement (CSDPA), AB 1584, SOPIPA, the Children's Online Privacy Protection Act (COPPA), or any other federal, state, or local law.

## 5. Limitation of Liability

To the maximum extent permitted by applicable law, Anyra and its officers, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including without limitation loss of profits, loss of data, or damages for personal injury, arising from or related to your use of the Tool.

In no event shall Anyra's total cumulative liability to you exceed one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. To the extent those exclusions or limitations are not enforceable in your jurisdiction, Anyra's liability is limited to the smallest amount permitted by law.

## 6. No Professional Advice

Nothing in the Tool or its accompanying documentation constitutes legal advice, compliance advice, educational advice, data-governance advice, or any other form of professional advice. Decisions about data sharing, compliance, and policy should be made in consultation with your district's data privacy officer, legal counsel, and information technology leadership.

## 7. Not a Compliance Certification

The Tool is a productivity aid. It is not:

- A FERPA compliance certification
- A CSDPA or AB 1584 compliance statement
- A COPPA compliance service
- A HIPAA-ready tool
- A SOC 2, ISO 27001, ISO 27701, or ISO 42001 certified system
- Subject to an external security audit

The Tool implements technical mitigations (cryptographic pseudonymization, k-anonymity cell suppression, multi-attribute uniqueness checks) that **reduce** re-identification risk. These mitigations do not **eliminate** re-identification risk. You are responsible for evaluating whether the residual risk is acceptable for your intended downstream use.

## 8. Changes to the Tool and These Terms

Anyra may modify the Tool and these Terms at any time. Changes take effect when a new version of the Tool is published. Continued use of a newer version constitutes acceptance of the revised Terms.

The version of the Tool in use is displayed in the footer of the tool interface.

## 9. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from or related to the Tool shall be brought in the state or federal courts located in Riverside County, California, and you consent to the personal jurisdiction of those courts.

## 10. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Anyra, its officers, contractors, and affiliates from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Tool; (b) your sharing of anonymized output; (c) your handling of source data or mapping files; (d) your violation of these Terms; or (e) your violation of any applicable law or third-party right.

Nothing in this section requires you to indemnify Anyra for Anyra's own gross negligence or willful misconduct.

## 11. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.
